These Terms of Service ("Terms") govern your access to and use of the Kindly (“GoKindlyAI, “GoKindlyAI.com”) website, application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. About Kindly
Kindly is a software-as-a-service (SaaS) platform that helps businesses manage and automate posting to their Google Business Profile. Kindly allows users to create, schedule, and publish Google Posts through authorized integrations with Google.
2. Eligibility
You must:
• Be at least 13 years old.
• Have the legal authority to enter into this agreement.
• Provide accurate registration information.
• Maintain the security of your account credentials.
You are responsible for all activity that occurs under your account.
3. Your Account
You agree to:
• Keep your account information current.
• Maintain the confidentiality of your login credentials.
• Notify us promptly of any unauthorized use of your account.
• Use the Service only for lawful purposes.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Google Integration
Kindly connects to your Google account only after you authorize access through Google's OAuth process.
By connecting your account, you authorize Kindly to:
• Access your selected Google Business Profile information.
• Create, schedule, update, and publish Google Posts on your behalf.
• Store only the information reasonably necessary to provide the Service.
You may revoke Kindly's access at any time through your Google Account security settings.
Kindly is not affiliated with, endorsed by, or sponsored by Google LLC.
5. User Content
You retain ownership of all text, images, and other content you submit to the Service.
You grant Kindly a limited license to use your content solely to provide the Service.
You represent that:
• You own or have permission to use all submitted content.
• Your content does not violate any law or third-party rights.
• Your content complies with Google's policies and applicable laws.
You are solely responsible for the content you publish.
6. Acceptable Use
You agree not to:
• Use the Service for unlawful purposes.
• Publish false, misleading, defamatory, or harmful content.
• Upload malware or malicious code.
• Attempt unauthorized access to the Service.
• Interfere with the operation or security of the Service.
• Reverse engineer or attempt to extract source code where prohibited by law.
7. Subscription and Payment
Some features of Kindly may require a paid subscription.
If you purchase a subscription:
• Fees are billed in advance.
• Subscription fees are non-refundable except where required by law.
• Your subscription renews automatically unless canceled before the renewal date.
• You may cancel at any time, and your subscription will remain active through the current billing period.
We may change pricing with reasonable notice before renewal.
8. Availability of the Service
We strive to provide reliable service but do not guarantee uninterrupted availability.
The Service may be temporarily unavailable because of:
• Scheduled maintenance
• Internet outages
• Third-party service interruptions
• Google API changes or outages
• Circumstances beyond our reasonable control
9. Third-Party Services
Kindly relies on third-party services, including Google.
Changes made by Google or other providers may affect the availability or functionality of the Service.
We are not responsible for outages, policy changes, or actions taken by third-party providers.
10. Intellectual Property
Kindly, including its software, branding, logos, graphics, and documentation, is owned by Kindly and protected by applicable intellectual property laws.
You may not copy, distribute, modify, or create derivative works from the Service except as expressly permitted.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available."
To the fullest extent permitted by law, Kindly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
• The Service will always be available.
• Posts will always publish successfully.
• Google will continue supporting any particular API or feature.
• The Service will be error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Kindly and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim shall not exceed the amount you paid to Kindly during the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold Kindly harmless from any claims, damages, liabilities, costs, or expenses arising from:
• Your use of the Service.
• Your content.
• Your violation of these Terms.
• Your violation of any law or third-party rights.
14. Termination
You may stop using the Service at any time.
We may suspend or terminate your account if:
• You violate these Terms.
• You misuse the Service.
• Continued access presents a security or legal risk.
Upon termination, your right to use the Service ends immediately.
